Restitution
If you are a victim of crime and the case is being prosecuted you may be eligible for restitution. If you have medical expenses or property damage because of the crime and you want to be repaid by the defendant, we need to hear from you and obtain documentation of your losses.
In order for us to accurately compute your monetary losses in your case for restitution purposes we need you to contact Victim Assistance at 503-373-4346 or toll free at 1-866-780-0960 as soon as possible. If you would prefer, you can also complete a restitution form and submit it directly to our restitution clerk.
If your insurance covered any of the losses, please make sure that we have a claim number, date of loss and phone number of your insurance company so that we may seek a restitution order for them as well.
If your case is closed and the defendant was ordered to pay restitution to you, you may obtain a copy of the Sentencing Order from Marion County Court Records, Marion County Courthouse, to determine the amount of restitution ordered and the time frame in which the defendant may have to begin making payments.
The defendant will make restitution payments to the Clerk of the Court who will then issue a check to you. If your address changes during the period in which you are to receive restitution payments, please notify the courts. You can do this by mailing the “Notice to Court Accounting Department” to the address indicated on the form.
IT HAS BEEN OUR EXPERIENCE THAT NOT ALL THE DEFENDANTS PAY AS ORDERED. If you do not receive a payment within ninety (90) days of the order, or if ninety (90) days lapse between payments, please send the notice “Regarding Delinquent Restitution Payments” to the address indicated on the form. If the defendant is supervised by the corrections department, the probation officer may notify the Court of the payment status. If the defendant is on probation to the Court, this form will serve as notice to the Court. If the defendant is sentenced to Oregon Corrections Department, restitution payments will not commence until he is released from prison.
You may have other legal rights, including the right to sue the defendant. The District Attorney’s Office is not allowed to represent individual victims suing defendants. If you plan to sue, it will be necessary to contact a private attorney. The Oregon State Bar has a toll free referral number if you do not have a lawyer and you wish private legal advice. There is also a program that addresses medical costs and expenses for personal injury and mental trauma caused by violent crime. This program is administered through the Oregon Department of Justice, Crime Victims’ Assistance Section.
